Birth Right Citizenship?

This Discussion about President Trump’s Executive Order denying Birth Right Citizenship is being attacked by those on the Right & Left, and they actually believe he’s wrong on this issue even though there’s No Law Congress ever passed allowing it.

Dred Scott an enslaved Black man, sued for his freedom in 1846. Scott claimed that living in free states and territories made him a free man.
The Supreme Court ruled against Scott, stating that Black people could not be citizens and could not sue in federal court.
The decision also invalidated the Missouri Compromise, which attempted to balance the number of free and slave states.

What was the Impact?
The decision was a major factor that lead up to the Civil War.
The 14th Amendment was written to Overturn the Dred v. Scott decision of the U.S. Supreme Court, and particular Amendment was put in place in 1868 the Federal Civil Rights Act to Reverse Dred Scott v. Sandford declaring All Person Born in the US (not Subject to any Power,) and two years later which was a landmark Supreme Court case in 1857 that ruled that Black people were not citizens of the United States. The decision also declared that Congress could not prohibit slavery in Federal territories. Passed by the Senate on June 8, 1866, and ratified two years later, on July 9, 1868, the Fourteenth Amendment granted citizenship to all persons "born or naturalized in the United States," and at that time the basic reason was to Overturn the Dred v. Scott decision of those who were formerly enslaved people
I believe it will end up in the Supreme Court, and will do one of two things, it will uphold President’s Trump Order or will Rule against it.

We presently have many speaking out about this Executive Order such as TV Hosts, Commentators, Politicians, and So Called Experts from Academia, however I’ve yet to hear a History Lesson on this issue and don’t believe most of them know what they’re talking about and especially the Media Hosts.
Let’s look at the statement Subject to the Jurisdiction There of Not Owe Allegiance to Another Nation in the 14th Amendment.

Mexico Recognizes the Parent & Child as a Citizen & has Jurisdiction etc. over them, (I haven’t seen this discussed or the Mention of any of these Illegal Immigrants Reject the Citizenship to them or any other Nation), and there’s Nothing in the 14th Amendment to support Birth Right Citizenship.
Everyone including the Supreme Court Agreed with this until 1898, in the case U.S. v. Wong Kim Art who was born in the U.S. but his parents weren’t citizens but lawfully immigrated and nothing in the U.S. Constitution to Support this or Legislation.

There was No One Sure of Where this Rule came from and as it’s not in the Constitution or Law, however believe it May just have come from the Executive Branch, however no one know what Dept. in the Exec. Branch 1st stated it.

If the Supreme Court would rule in favor of Birth Right Citizenship which has no Historical Basis then they may as well Throw the Entire Constitution Out or In Time the Socialist who’ve been successful in Governing as if it doesn’t matter, which I believe we all witnessed especially in the Last 4 yrs. with Biden’s Administration and who can really say if in 4yrs. we don’t get another such Administration as the American Public has a History of Voting in People who Promise Everything but Deliver Nothing will be back in Authority then We can All get Ready to Lose more of our God Granted Rights which they just proved and haven’t yet told the Truth, nor have they Ended their Attacks on those we Voted into Authority to Undo what they’ve all done to us, as they’re as Guilty as the Biden Admin., after all they Passed his plans and caused pain, if you don’t Recall what they just did, then remember they’re still Out There Waiting to Do It Again, and if they do we’ll Lose it All.

A Couple more things, On the Political Side of this most Americans don't believe Illegals or New Borns have a Birth Right since they're still subject to their Native land, entered illegally, and any Politicians that stand against this on either side may just have problems in 24 & 26 Election Cycle, and I hope they have to Pay 4 It.

Common Sense; Let's say My neighbor has a pregnant daughter and she decides that she doesn't want to live with her parents and our family has always gotten along with her, so while we're on vacation she enters our Home, and when we arrive back she's given birth and then expects us to give the child our name and support her and the baby, would that be legal or for that matter reasonable in a community or court?

I don't believe it would and even if they were visiting and their daughter gave birth as a guest apply the same story, what would the community or courts say, this is just common sense to me.

Study why our Founders reasons for what they did is reasonable, as we were then surrounded by foreign european nations, England, Spain and France and they weren't about to make citizens of their children who one day would vote or hold office, and recall not long after a Nation England Invaded the USA again War of 1812, so hope others understand we're still surrounded by Foreign Nations, and I don't believe we should give Amnesty or Citizenship to those who began their stay here Illegally.

One closing Question; Why do they fly the Mexican Flag?

God Bless You All; Clair Van Steenwyk
